1. Acceptance of Terms
Welcome to Metabolic Restore. These Terms of Service ("Terms") govern your use of our website at metabolicrestore.health and the functional medicine services we provide.
By accessing our website, scheduling consultations, or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our website or services.
2. Services Provided
Metabolic Restore provides functional medicine consulting services, including:
- Health consultations and assessments
- Coordination of functional laboratory testing (DUTCH, GI-MAP, etc.)
- Personalized health protocols and recommendations
- Nutritional and lifestyle guidance
- Supplement recommendations
- Ongoing health optimization support
2.1 Not a Substitute for Medical Care
Important: Our services are NOT a substitute for professional medical advice, diagnosis, or treatment. We are a functional medicine practice focused on health optimization and root-cause analysis. We do not:
- Diagnose or treat medical conditions
- Prescribe pharmaceutical medications
- Provide emergency medical care
- Replace your primary care physician or specialist
Always consult with a licensed physician for medical concerns, emergencies, or before making changes to prescribed medications.
2.2 Telehealth Services
We provide telehealth consultations via secure video conferencing. By participating in telehealth appointments, you acknowledge:
- The limitations of remote consultations compared to in-person visits
- The requirement for a reliable internet connection
- Your responsibility to be in a private, quiet location during consultations
- Your consent to use telehealth technology for your care
3. Client Responsibilities
As a client of Metabolic Restore, you agree to:
- Provide Accurate Information: Provide complete and truthful information about your health history, symptoms, medications, and supplements
- Follow Protocols: Follow recommended protocols to the best of your ability
- Communicate Changes: Inform us of any changes to your health status, medications, or symptoms
- Coordinate with Physicians: Keep your primary care physician informed of our recommendations and testing
- Attend Appointments: Attend scheduled appointments or provide 24-hour notice for cancellations
- Ask Questions: Ask questions if you don't understand any recommendations
- Make Your Own Decisions: Take responsibility for your own health decisions and outcomes
4. Appointment Scheduling and Cancellation
4.1 Scheduling
Appointments are scheduled through our online booking system (Better.to) or Practice Better client portal. Discovery calls are complimentary; paid consultations require advance payment.
4.2 Cancellation Policy
- 24-Hour Notice Required: Cancellations or reschedules must be made at least 24 hours before your scheduled appointment
- Late Cancellations: Cancellations with less than 24 hours notice will be charged 50% of the consultation fee
- No-Shows: No-shows (failure to attend without notice) will be charged 100% of the consultation fee
- Emergencies: We understand emergencies happen; contact us as soon as possible, and we will work with you on a case-by-case basis
4.3 Late Arrivals
If you arrive more than 15 minutes late to a scheduled appointment, we reserve the right to reschedule the appointment. You will be charged for the missed appointment per our cancellation policy.
5. Fees and Payment
5.1 Service Fees
Current service fees are available on our website and during the discovery call. Fees may include:
- Initial consultation fees
- Follow-up consultation fees
- Functional laboratory testing fees
- Program enrollment fees
5.2 Payment Terms
- Payment Required: Payment is required at the time of booking for consultations and at the time of order for laboratory tests
- Payment Methods: We accept credit cards, debit cards, and HSA/FSA cards through our secure payment processor
- Programs: Program fees must be paid in full or according to the agreed payment plan
5.3 Refund Policy
- Services: Consultation fees are non-refundable once services have been rendered
- Laboratory Tests: Test fees are non-refundable once tests have been ordered or shipped
- Programs: Program fees may be refundable within 7 days of enrollment if no services have been used (minus a processing fee)
- Exceptions: Refund exceptions will be considered on a case-by-case basis
5.4 Price Changes
We reserve the right to modify our fees at any time. Current clients will be notified of fee changes at least 30 days in advance. Fee changes do not apply to services already purchased.
6. Laboratory Testing
6.1 Test Coordination
We coordinate functional laboratory testing through CLIA-certified labs. Tests may include DUTCH hormone panels, GI-MAP stool analysis, metabolic panels, and other specialized tests.
6.2 Client Responsibility
- Test Completion: You are responsible for completing test kits according to instructions and returning them to the lab by the specified deadline
- Sample Quality: We are not responsible for sample issues that result from improper collection or delayed shipment
- Test Fees: Test fees are separate from consultation fees and are paid directly to the lab or through our practice
- Insurance: Functional tests are typically not covered by insurance; you are responsible for all testing costs
6.3 Test Results
Test results are reviewed during follow-up consultations. We do not provide test results without a consultation to discuss findings and recommendations.
7. Supplements and Products
7.1 Recommendations
We may recommend professional-grade supplements and health products as part of your protocol. These recommendations are based on your individual assessment and testing.
7.2 No Guarantees
We do not guarantee specific results from any supplement or protocol. Individual responses vary based on genetics, compliance, lifestyle factors, and underlying health conditions.
7.3 Quality and Sourcing
We recommend professional-grade supplements from reputable manufacturers. You are free to purchase supplements from any source, though we cannot guarantee the quality of products purchased outside our recommendations.
7.4 Allergies and Reactions
You are responsible for informing us of any known allergies or sensitivities. Discontinue any supplement immediately if you experience adverse reactions and contact us.
8. Confidentiality and HIPAA
We are committed to protecting your privacy and complying with HIPAA (Health Insurance Portability and Accountability Act).
- Protected Health Information: Your health information is confidential and will not be shared without your consent, except as required by law

AS-IS BASIS: Our website and services are provided "as is" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

- Our total liability shall not exceed the amount you paid for services in the 12 months prior to the claim

- We are not liable for any technical issues, data loss, or unauthorized access to our systems
ASSUMPTION OF RISK: You acknowledge that you assume all risk associated with using our services and following our recommendations.
13. Indemnification
You agree to indemnify, defend, and hold harmless Metabolic Restore, its practitioners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any laws or regulations
- Your violation of any third-party rights
14. Termination
14.1 Termination by You
You may terminate our services at any time by providing written notice. Refunds will be issued according to our refund policy.
14.2 Termination by Us
We reserve the right to terminate services to any client who:
- Violates these Terms
- Engages in abusive or harassing behavior
- Fails to pay for services
- Provides false or misleading information
- Is non-compliant with recommendations despite repeated guidance
14.3 Effect of Termination
Upon termination:
- You will no longer have access to our client portal and services
- Any outstanding fees become immediately due
- We will maintain your health records as required by law
- You may request copies of your records (fees may apply)
15. Dispute Resolution
15.1 Informal Resolution
If you have a concern or dispute, please contact us first at chris@metabolicrestore.health. We will make every effort to resolve the issue informally.
15.2 Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Minnesota.
15.3 Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class actions or class-wide arbitration.
15.4 Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website with a new "Last Updated" date
- Sending email notification to active clients
Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
